What is an accident?

An accident, as it relates to personal injury law, is an event that occurs due to the fault or negligence of another party. The accident can result in various types of damage, both physical and mental, as well as to property involved in the accident. For example, when a driver is in an auto accident, there may be injury to the driver’s car. Additionally, the driver and/or passengers may suffer a physical injury, such as a broken leg or a spinal injury. The driver, or the passengers, may also suffer from emotional damage, like pain and suffering.

Typically, an accident is attributable to an individual or an entity, such as a business that did not properly maintain its premises or workplace environment.

What is the legal process involved in an accident?

To recover damages in a personal injury case, the person bringing the case (the accident victim or ‘plaintiff’) must be able to show that the other involved party (the party at fault, or the ‘defendant’)was negligent. Negligence, put simply, is the failure of the defendant to act with reasonable care, such failure resulting in an injury to the plaintiff.

A personal injury lawyer will interview the victim about the accident. If the victim has been keeping detailed medical records or has any other relevant documentation pertaining to the accident, the lawyer will review these documents. The attorney may also interview any witnesses or other individuals who may have information about the accident.

Once the attorney has gathered enough information, a complaint will be filed against the negligent party. After the complaint has been filed, a discovery process will begin, which is where both parties to the lawsuit will gather evidence in support of their individual positions.

Sometimes, an accident is clearly the fault of an individual or an entity. When this is the case, the attorneys for both sides may attempt to negotiate a settlement agreement,saving both time and money. If the two parties can agree on an appropriate amount of damages for the plaintiff, the case will not have to go to trial. Unfortunately, a settlement agreement is not always possible, especially if some of the facts of the case are disputed, or if the plaintiff contributed in some way to his or her injury.

After the discovery period has ended, and if no settlement could be reached, the case will go to trial in front of a judge or jury. During trial, both parties will have a chance to make their case in front of impartial individuals who will weigh the evidence and make a determination of fault based on the case presented to them. Additionally, the jury or judge will also make a determination as to the type and amount of damages to be awarded to the plaintiff.
